1. Agreement To These Terms

These Terms of Use ("Terms") govern your use of the Tripcerto website, web application, and related services ("Services").

Tripcerto is operated by TRIPCERTO LTD, a private limited company registered in England and Wales with company number 16121124 ("Tripcerto", "we", "us", or "our").

By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy.

2. Eligibility

You must be at least 16 years old, and legally capable of entering into a binding agreement, to use the Services.

If you are using the Services on behalf of a company or other organisation, you represent that you have authority to bind that organisation.

3. Your Account

You are responsible for:

providing accurate account information
maintaining the confidentiality of your login credentials
all activities that occur under your account

You must notify us promptly at hello@tripcerto.com if you believe your account has been accessed without authorisation.

4. The Services

Tripcerto provides travel-planning, recommendation, research, collaboration, review, profile, media-sharing, and related tools.

Some features may use AI-generated outputs, third-party travel content, maps, or place data.

We may change, suspend, or discontinue all or part of the Services at any time.

5. AI Features Disclaimer

Tripcerto may generate recommendations, summaries, or other outputs using automated systems and third-party AI providers.

You understand and agree that:

AI-generated output may be incomplete, inaccurate, outdated, or inappropriate for your circumstances
travel conditions, pricing, availability, safety conditions, entry rules, and third-party content may change at any time
you are responsible for independently verifying important travel information before acting on it

Tripcerto does not guarantee that any recommendation, itinerary, summary, or ranking is correct, available, or fit for your particular purpose.

6. Pre-Release And Demo Features

Parts of the Services may be offered in pre-release, beta, demo, or preview form. Pre-release features:

are provided for evaluation and feedback purposes
may be limited in scope, functionality, or geographic coverage
may not represent the quality, completeness, or performance of the final service
may be changed, paused, or removed at any time without notice

By using a pre-release or demo feature, you acknowledge that it is not a finished product and accept the additional limitations described in this section and in Sections 5 and 16.

7. User Content

User Content means information or material you submit, post, upload, message, store, or otherwise make available through the Services, including:

profile information
trip plans
trip reviews
trip moments
messages
photos
videos
feedback

You retain ownership of your User Content, subject to the rights you grant below.

8. Licence You Grant To Tripcerto

By submitting User Content, you grant Tripcerto a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt, process, display, perform, distribute, and otherwise use the User Content as necessary to:

operate and provide the Services
process and display your content
support collaborative and public-sharing features you choose to use
moderate, secure, and improve the Services
generate derived formats such as thumbnails, previews, and technical transformations

This licence ends for content you delete from the active service, except to the extent the content has already been shared with others, retained in limited backup systems, or must be kept for legal, security, or compliance reasons.

9. Public And Shared Content

Some content in the Services may be public or visible to other users, including public profile information and content you intentionally share through collaborative or social features.

You are responsible for deciding what content to make public or share with others.

10. Your Responsibilities

You agree not to:

violate any law or regulation
infringe or misappropriate another party’s rights
upload malicious code or interfere with the operation or security of the Services
scrape, crawl, or harvest the Services except as expressly permitted by us
attempt to gain unauthorised access to accounts, systems, or data
upload content you do not have the right to use or share
submit unlawful, defamatory, harassing, hateful, fraudulent, or sexually exploitative content
misuse collaborative or messaging features
use the Services to build a competing dataset or model where prohibited by applicable law or contract

11. Travel, Safety, And Third-Party Services

Tripcerto is not a travel agency, airline, hotel operator, insurer, immigration adviser, or emergency-response provider unless explicitly stated otherwise in a separate written agreement.

Third-party services, links, maps, place data, and travel content may be provided for convenience only. We are not responsible for third-party products, services, content, availability, or policies.

12. Privacy

Your use of the Services is also governed by our Privacy Policy.

13. Suspension And Termination

We may suspend or terminate your access to the Services, with or without notice, if:

you violate these Terms
we reasonably believe your conduct creates risk or liability
we are required to do so by law
continued operation of your account is no longer commercially or technically feasible

You may stop using the Services at any time. Account deletion and data-retention details are described in the Privacy Policy.

14. Intellectual Property

The Services, including our software, design, branding, text, graphics, interfaces, and other materials, are owned by Tripcerto or its licensors and are protected by intellectual-property laws.

Except for the limited right to use the Services under these Terms, no rights are granted to you.

15. Feedback

If you provide suggestions, ideas, or feedback about the Services, we may use them without restriction or compensation to you, unless prohibited by law.

16. Disclaimers

THE SERVICES ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIPCERTO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, error-free, or that any content will be accurate or reliable.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

TRIPCERTO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY
TRIPCERTO’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF £100 OR THE AMOUNTS YOU PAID TO TRIPCERTO FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AROSE

18. Indemnity

To the extent permitted by law, you will indemnify and hold harmless Tripcerto and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising out of:

your User Content
your misuse of the Services
your violation of these Terms
your violation of another person’s rights or applicable law

19. Governing Law And Venue

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules.

Any dispute arising out of or relating to these Terms or the Services shall be resolved in the courts of England and Wales, unless applicable law requires otherwise.

20. Changes To These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice as appropriate. Your continued use of the Services after the updated Terms become effective means you accept the updated Terms.
